2018- $3.25 Million Medical Malpractice Settlement
In 2018, Susan and Todd Petersen negotiated a $3.25 million settlement in a medical negligence case. Their client claimed that the emergency room physicians failed to appropriately address the signs and symptoms of a life threatenting blood clotting reaction, known as heparin induced thrombocytopenia. Instead, the woman was discharged to home only to return to the ER two days later with clots in both legs, lungs, and aorta. She claimed that the delay in diagnosis and subsequent re-exposure to heparin during her admission resulted in the loss of her leg below the knee. 2016 – $1.5 Million Nursing Home Death Settlement
In 2016, Petersen & Petersen negotiated a $1.5 million settlement in a nursing home negligence and wrongful death claim. The client claimed that a greater than 75 year old woman was the victim of substandard nursing care during an inpatient rehabilitation stay following a five day stay at the hospital for pneumonia. She was readmitted in stable condition. She was found unconscious and unresponsive less than 24 hours later. Plaintiff brought suit, alleging the nursing care was negligent and caused the women’s death. Punitive damages were also alleged. The defendant nursing provider disputed the allegations. 2015 – $17 Million Natural Gas Explosion Settlement
Petersen & Petersen obtained a $17 Million Natural Gas Explosion Settlement on Day 5 of Trial. A home explosion and fire caused by an uncapped gas line following negligent retail appliance delivery, death of an 87 year old man and emotional injuries to an 89 year old widow.
2015 – $2 Million Wrongful Death/Negligent Prescription Settlement
The firm is proud to report this policy limits settlement in a physician negligence case. The negligence involved a physician’s off-label prescription of a medication for a purely cosmetic purpose which resulted in patient’s fatal cardiac arrhythmia.
2014 – $675,000 Combined Jury Verdict and Settlement
Todd and Susan Petersen obtained a $675,000 verdict in Lake County Common Pleas Court for an injury victim against his own insurance company for breach of his contract for underinsured motorist coverage. After the company failed to offer reasonable value of his permanent hand injuries, the Petersens took the case to a jury trial and obtained four times the insurance company’s offer.
2013 – $1.33 Million Combined Settlement Motor Vehicle Neligence/Insurance Agent Errors & Omissions
Petersen & Petersen obtained this combined settlement relative to the negligence of another driver responsible for the fatality of a motorcycle passenger and injuries to its driver as well as the negligence of the couple's insurance agent to procure coverage for the motorcycle under the umbrella policy purchased shortly before the crash.
2013 – $900,000+ Wrongful Death Settlement in Anesthesia Negligence Case
Petersen & Petersen obtained a confidential settlement of just over $900,000 in a wrongful death case against a nurse anesthetist for negligent clearance prior to elective cosmetic surgery. The patient -- who had undiagnosed cardiac disease -- died of cardiac complications two days after surgery.
2012 – $170,000 Jury Verdict in Lake County Common Pleas Court
Petersen & Petersen returned to Lake County Common Pleas Court, representing a victim of negligence. Attorney Todd Petersen had the privilege of representing a young lady injured in an automobile collision two days after she turned 18 years-old. Before trial, the defendant’s insurance company made a final offer of just $16,500. After two days of trial before Judge Vincent Culotta, the Jury deliberated for three hours before returning a $171,000 verdict.
2012 – $1.635 Million Dollar Settlement in Wrongful Death Nursing Negligence/ Premises Liability Case
Plaintiff’s counsel alleged that a greater than 70 year old woman was the victim of substandard nursing care during an inpatient rehabilitation stay following an injury for a fall that occurred prior to admission. In the fall, the woman suffered a significant laceration of her knee and subsequent complications. The woman died several weeks later of sepsis. Plaintiff brought suit, alleging the nursing care was negligent and caused the woman’s death. Punitive damages were also alleged against the facility. The defendant nursing provider disputed the allegations. The case also included a premises liability claim against the business owner where the original slip and fall occurred. 2011 – Record Personal Injury Auto Verdict in Lake County
After 1 1/2 days of trial, a Lake County jury returned a $457,060 verdict in a personal injury auto case. Attorney Susan Petersen obtained the verdict on behalf of a 72 year old woman who was injured in an motor vehicle collision. The client suffered a cervical neck strain which progressed into a painful and chronic neck injury, requiring ongoing annual care and ultimately, a serious neck surgery in her future. The other driver admitted fault after running a stop sign at 45 mph and crashing into the woman's pickup truck. The defense argued that the crash caused only five months of injury and the ongoing neck pain was due to the woman's old age and pre-existing degenerative disc disease in her neck. Susan successfully convinced the jury that all of the harms, including the future required care and surgery, were caused by the crash. According to the Judge's staff, the verdict was the largest in the 32-year history of his courtroom. Susan successfully wrapped up the case with the Defendant’s insurance company for $490,000 after filing post-judgment motions for interest and costs. The defendant's insurance company's offer on the day of trial was $15,000.
